HRERA rules a fully paid buyer can resell even if the builder delays the conveyance deed

In an order dated September 10, 2026, the Haryana Real Estate Regulatory Authority in Gurugram sided with a buyer of a commercial shop in Sector 37C whose developer, Apex Build-well, had held up the buyer's attempts to transfer the unit. The buyer had paid about Rs 27 lakh in full and taken possession, but the conveyance deed was only executed in January 2023, nearly three years after the occupation certificate.

The authority held that the right to sell or transfer is a basic right of an owner, and a promoter cannot block it simply because it was late with its own paperwork. It directed the developer to pay 11% annual interest on the amount for the delay period, plus Rs 1 lakh for harassment and Rs 50,000 towards legal costs.

For anyone buying in Gurugram, this is a useful reminder that HRERA protects your exit options once you have paid in full.
