Buying property in India as an NRI.
The rules come from the Foreign Exchange Management Act (FEMA) and RBI guidelines. Here is what they mean in practice.
Who can buy
Non-Resident Indians (Indian citizens living abroad) and Overseas Citizens of India (OCI cardholders) can buy residential and commercial property in India without RBI approval.
What you cannot buy
Agricultural land, plantation property and farmhouses cannot be bought by NRIs or OCI cardholders (they can be inherited). Apartments, floors, villas, residential plots and commercial space are all fine.
How to pay
Pay through normal banking channels: an inward remittance from abroad, or from your NRE, FCNR(B) or NRO account in India. Payments in foreign currency notes or traveller’s cheques are not allowed.
Home loans
Indian banks and housing finance companies lend to NRIs. EMIs are paid from your NRE or NRO account or by remittance from abroad.
Sending money back
On sale, you can repatriate up to the amount you originally paid in foreign exchange, for up to two residential properties. Other proceeds can be moved from your NRO account within the USD 1 million per financial year limit, after tax.
Tax
Rental income from an Indian property is taxable in India. When you sell, the buyer deducts TDS before paying you. A Double Taxation Avoidance Agreement with your country may give you credit for tax paid here, so speak to a chartered accountant.
Power of attorney
You do not have to fly in for every step. A relative or trusted person can act for you under a power of attorney. One signed abroad is attested at the Indian embassy or consulate (or apostilled) and then stamped in India.

Can an OCI cardholder buy property in Gurugram?
Yes. OCI cardholders can buy residential and commercial property in India on the same footing as NRIs. The exception is agricultural land, plantation property and farmhouses.
Do I need RBI permission to buy?
No. Buying residential or commercial property as an NRI or OCI cardholder does not need RBI permission, as long as payment comes through normal banking channels.
Can I get a home loan while living abroad?
Yes. Most Indian banks and housing finance companies offer home loans to NRIs. Eligibility depends on your overseas income, employment and credit history.
Can I buy without travelling to India?
Largely, yes. Site visits can be done on video, and a power of attorney holder in India can handle registration and handover for you.
Can I rent the property out?
Yes. You can let the property and receive rent into your NRO account. Rental income is taxable in India.
Can I send the sale money back abroad?
Yes, within limits. You can repatriate up to the amount originally paid in foreign exchange, for up to two residential properties, and other proceeds from your NRO account within the USD 1 million a year limit, after taxes.
